Sexual violence policy

Eastview College the college will implement its SVHP in accordance with the regulations under the Private Career Colleges Act, 2005.

Eastview College is committed to being a safe and positive space where members of the Eastview College community feel able to work, learn, and express themselves in an environment free from sexual violence. We endeavour to reduce sexual violence in the Eastview College community and create a safe space for survivors and those who are affected by sexual violence.

Brampton Career Colleges

All reported incidents of sexual violence will be investigated and in a manner that ensures due process. It is the intention of Eastview College that individuals feel comfortable about making a report in good faith about sexual violence that they have experienced or witnessed.

Eastview College recognizes that sexual violence can occur between individuals regardless of sexual orientation, gender, gender identity, or relationship status as articulated in the Ontario Human Rights Code. We also recognize that individuals who have experienced sexual violence may experience emotional, academic, financial, or other challenges.

Eastview College is committed to:

  • Participating with internal and external stakeholders in the creation of a campus atmosphere in which sexual violence is not tolerated
  • Treating individuals who disclose sexual violence with compassion and recognizing them as a decision maker regarding their interests
  • Assisting those who have been affected by sexual violence by providing choices, including detailed information and support, which may include a provision of and/or referral to counselling and medical care, information about legal options, and appropriate academic, work, and other accommodations
  • Ensuring that those who disclose that they have been sexually assaulted have their experiences validated, and that their right to dignity and respect is protected throughout the process of disclosure, investigation, and institutional response
  • Engaging in appropriate procedures for investigation and adjudication of a complaint that ensures fairness and due process
  • Ensuring coordination and communication among the various departments that are most likely to be involved in the response to sexual violence on campus
  • Engaging in public education and prevention activities, which include appropriate training of the Eastview College community about responding to the disclosure of sexual violence, and

Sexual Violence Definition: Any sexual act or act targeting a person’s sexuality, gender identity or gender expression, whether the act is physical or psychological in nature that is committed, threatened or attempted against a person without the person’s consent. This includes, but is not limited to sexual assault, sexual harassment, stalking, indecent exposure, voyeurism, sexual exploitation, degrading sexual imagery, distribution of sexual images or video of a community member without their consent, and cyber harassment or cyber stalking of a sexual nature.

Eastview College has sexual violence policy which

  • (a). Provides information about the supports and services available at the private career college or through its agent for students who are affected by sexual violence, and identifies who should be contacted to obtain such supports and services;
  • (b). provides information about the supports and services available in the community for students who are affected by sexual violence;
  • (c). informs students that the Eastview College will appropriately accommodate the needs of students who are affected by sexual violence,
  • (d). Informs students that they are not required to report an incident of, or make a complaint about, sexual violence in order to obtain the supports and services referred to in clause
  • (a). or the accommodation referred to in clause (c)

Procedure for Complaint:

  • 1). The student can report an incident of, or make a complaint about, sexual violence including the specific official, office or department to College Manager Ajay Sharma. College Manager: Ajay Sharma Eastview College Ph: 905-497-0507, Email: [email protected]
  • 2). For the purpose of protecting the student reporting an incident of, or making a complaint about, sexual violence from retaliation and the threat of retaliation all complaints are handled only by the College Manager.
  • 3). The College Manager Ajay Sharma will decide whether an incident or complaint of sexual violence will be investigated by the Eastview College or by concerned legal authorities
  • 4). The student may choose not to request an investigation by the Eastview College, and has the right not to participate in any investigation that may occur.
  • 5). Eastview College will be part of the investigation and decision-making processes with concerned legal authorities that will take place if an incident or complaint of sexual violence is investigated.
  • 6). The decisions made by the College Manager Ajay Sharma or concerned legal authorities and measures after an incident or complaint is investigated will be final
  • 7). The personal information of the student involved in the investigation of an incident or complaint will always be kept confidential.
  • 8). If students, in good faith, report an incident of, or make a complaint about, sexual violence, they will not be subject to discipline or sanctions for violations of the Eastview college’s policies relating to drug or alcohol use at the time the alleged sexual violence occurred.
  • 9). Student who disclose their experience of sexual violence through reporting an incident of, making a complaint about, or accessing supports and services for sexual violence, will not be asked irrelevant questions during the investigation process by the Eastview college’s staff or investigators, including irrelevant questions relating to the student’s sexual expression or past sexual history.

Appeal

  • (a). Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the Director of the College within 5 days by submitting a letter addressed to: Eastview College
  • (b) Making False Statements
    • (a). ) It is a violation of this Sexual Violence Policy for anyone to knowingly to make a false complaint of sexual violence or to provide false information about a complaint.
    • (b). Individuals who violate this Sexual Violence Policy are subject to disciplinary and / or corrective action up to and including termination of employment of instructors or staff or expulsion of a student.
    • (c). If a person, in good faith, discloses or files a sexual violence complaint that is not supported by evidence gathered during an investigation, that complaint will be dismissed.

Reprisal

  • (a). It is a violation of this Sexual Violence Policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of sexual violence, provided information related to a complaint, or otherwise been involved in the complaint investigation process.
  • (b). Individuals who violate the Sexual Violence Policy are subject to disciplinary and / or corrective action, up to and including termination of employment of instructors or staff or expulsion f a student.

Confidentiality

  • 1. Confidentiality is particularly important to those who have disclosed sexual violence.
  • 2. The confidentiality of all persons involved in a report of sexual violence must be strictly observed and Eastview does its best to respect the confidentiality of all persons, including the complainant, respondent, and witnesses, by restricting routine access to information to individuals with a need for such access, as well as providing education and training to those who are regularly involved in the administration of reports and complaints.
  • However, confidentiality cannot be assured in the following circumstances:
    • An individual is at imminent risk of self-harm
    • An individual is at imminent risk of harming another, and/or
    • There are reasonable grounds to believe that others in the Eastview or wider community may be at risk of harm.
  • In such circumstances, information would only be shared with necessary services to prevent harm, and the name of the survivor would not be released to the public.
  • 3. Where Eastview becomes aware of an allegation of sexual violence by a member of the Eastview community against another member of the Eastview community, Eastview may also have an obligation to take steps to ensure that the matter is dealt with in order to comply with Eastview’s legal obligation and/or its policies to investigate such allegations.
  • 4. In such cases, certain Eastview management will be informed about the reported incident on a ‘need to know’ and confidential basis, but not necessarily of the identities of the persons involved.

Review

  • (a).Eastview College shall ensure that student input is considered in the development of its Sexual Violence Policy and every time it is reviewed or amended.
  • (b). Eastview College shall review its Sexual Violence Policy 3 years after it is first implemented and amend it where appropriate.
  • Collection of Student Data (a Eastview College shall collect and be prepared to provide upon request by the Superintendent of Private Career Colleges such as data and information as required according to Subsection 32.3 (8), (9) and (10) of Schedule 5 of the Private Career Colleges Act, 2005 as amended.
  • Any information about the support services available at Eastview College can be found at the front desk. For any particular concern, College Manager can be contacted.
